Blink ("we", "our", or "us") is operated by Blink, located at 41 Rue de l'alouette, 94160 Saint-Mandé, France. We build AI-powered tools that automate Instagram Direct Message responses on behalf of businesses, using the official Instagram Messaging API provided by Meta Platforms, Inc.

2. Data We Collect

Blink is designed with a minimal data approach. When you connect your Instagram account, we access only what is strictly necessary to operate the AI agent. Specifically, we collect:

• Instagram conversation data: The content of Direct Message conversations you select for automation, accessed via the Instagram Messaging API. This is the only Instagram data we store.
• OAuth access token: A token granted by Meta that allows us to read and send messages on your behalf. We do not store your Instagram password.
• Account registration data: Your name and email address when you create a Blink account.

We do not collect or store your Instagram profile details, posts, media, Stories, follower data, analytics, or any other account information beyond the conversations you explicitly select.

3. How We Use Your Data

We use the data collected solely for the following purposes:

• To power the AI agent that automatically responds to your selected Instagram conversations.
• To operate and improve the Blink platform.
• To send you service-related communications (e.g., account alerts, product updates).
• To comply with legal obligations and Meta's Platform Terms.

We do not sell, rent, or share your data or Instagram conversation data with any third party for advertising, marketing, or any other commercial purpose.

4. Meta & Instagram API Compliance

Our use of the Instagram Messaging API is governed by Meta's Platform Terms and Developer Policies. We access your Instagram messages only with your explicit authorization via OAuth 2.0, and we request only the minimum permissions needed to operate the AI agent. Data obtained through Meta APIs is used exclusively as described in this policy.

5. Data Sharing

We do not sell your data. We may share your data only with:

• AI processing providers: Third-party AI services used to generate automated replies, under strict data processing agreements that prohibit them from storing or using your data for any other purpose.
• Hosting providers: Cloud infrastructure providers who store your data on our behalf under confidentiality agreements.
• Legal requirements: When required by law, court order, or to protect our legal rights.

6. Data Retention

We retain conversation data only for as long as your AI agent project is active. When you delete a project, disable your account, or submit a deletion request, we permanently delete all associated conversation data immediately from active systems, and within 30 days from backups. We do not keep archives of your Instagram messages beyond what is operationally necessary.

7. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate or incomplete data.
• Deletion: Request deletion of your personal data. See our Data Deletion page for more details.
• Portability: Request your data in a portable, machine-readable format.
• Objection: Object to certain types of data processing.
• Withdraw consent: Revoke Instagram API access at any time via Meta's settings.

8. Security

All conversation data processed by Blink is encrypted in transit using TLS and encrypted at rest. OAuth tokens are stored securely and never exposed in client-side code. We apply strict access controls so that only the systems required to run your AI agent can access your conversation data.

We use essential cookies to maintain your login session and preferences. We may use analytics cookies to understand how our platform is used. You can manage cookie preferences through your browser settings.

10. Children's Privacy

Our services are not directed to individuals under the age of 13. We do not knowingly collect personal data from children. If you believe we have inadvertently collected such data, please contact us immediately.

By accessing or using Blink ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Blink provides an AI-powered platform that automates Instagram Direct Message responses on your behalf. Using the official Instagram Messaging API, Blink allows you to create projects in which an AI agent reads and replies to conversations you select. Blink does not schedule posts, manage comments, or access any Instagram data beyond the conversations required to operate your AI agent.

3. Eligibility

You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you have the full legal authority to enter into these Terms on behalf of yourself or your organization.

4. Account Registration

To use the Service, you must create an account and connect your Instagram Business account via Meta's OAuth process. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Instagram & Meta Platform Terms

Use of our Service in connection with Instagram requires you to also comply with Meta's Terms of Service and Community Guidelines, as well as the Instagram Terms of Use. Our Service may only be used with Instagram Business or Creator accounts. You acknowledge that:

• We are an independent service provider and not affiliated with or endorsed by Meta Platforms, Inc.
• Your use of Instagram through our Service is subject to Instagram's own terms and policies.
• Meta may revoke API access at any time, which may affect the availability of our Service.
• You are solely responsible for the content you publish through our Service.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Violate Meta's Platform Terms, Instagram's Terms of Use, or Community Guidelines.
• Transmit spam, unsolicited messages, or engage in artificial engagement practices.
• Scrape, crawl, or harvest data from Instagram beyond what is explicitly permitted by the API.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Upload or distribute malware, viruses, or other harmful code.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Blink. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. Content you publish through our Service remains your intellectual property.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We handle your Instagram data in accordance with our Privacy Policy and Meta's Platform Terms.

9. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time; see our Data Deletion page for information on data removal.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. The availability of the Service depends in part on Meta's API availability, which is outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, Blink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of France.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a prominent notice on the platform. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

What Gets Deleted

When you submit a data deletion request, we will permanently delete the following:

• Your Blink account profile and login credentials.
• All Instagram conversation data stored to operate your AI agent projects.
• OAuth access tokens used to connect to your Instagram account.
• All AI agent project configurations associated with your account.
• Any support or contact communications you submitted.

We do not store Instagram posts, media, analytics, follower data, or any other account information — so there is nothing else to delete.

How Long It Takes

We will confirm receipt of your request within 24 hours. Deletion from our active systems is completed immediately upon confirmation. Deletion from backup systems is completed within 30 days. You will receive an email confirmation once deletion is complete.

Disconnect Instagram First

To revoke our app's access to your Instagram account directly, you can also visit Instagram Settings → Apps and Websites and remove Blink from your connected apps. This immediately revokes our API access, even before we process your deletion request.
